Aviva Appealed, alleging that Arbitrator Matheson erred by:

1. Misinterpreting the Schedule;
2. Failing to provide adequate reasons;
3. Refusing to qualify Dr. Aiello as an expert witness;
4. Making findings of fact in the complete absence of evidence;

Director’s Delegate Murray heard the Appeal, and determined that Aviva was unable to establish that Arbitrator Matheson made any errors in law, and therefore the Appeal was dismissed with costs of $7,500.00 payable to the Respondent Mr. Dadi.
