What is a Will & Why do I need one?
Your Last Will and Testament is a key item in your estate plan. A Will is a legal document which provides your clear instructions and intentions to your Estate Trustee for what you would like to happen with your estate and assets upon your death. This includes the names of your choice for Estate Trustee, Guardian, beneficiaries, and the conditions you would like to be followed upon your death. Without a valid Will, your wishes may not be known or satisfied upon your death. Without a Will, default rules of the Court will determine your estate’s disposition, including choosing your beneficiaries, the transfer of assets and real estate and possessions, the people who may help administer your estate, etc. Often, the assets of the estate (ie your hard earned money!) will be used to fund these Court proceedings. Difficult and expensive proceedings can be avoided in most instances with a Will, and by contacting a lawyer today.
How can I get a Will Drafted?
In Ontario, a handwritten, or holographic, Will is legal. However, in order to ensure that the specific legislated rules of Wills are complied with, allow Clausi Law to collect your personal information, and review the details of your choices with you first. After we have confirmed your wishes and you have made an informed choice, we can draft your Will, review it with you (and your spouse’s Will, which is often the case), and advise you of any special issues you should be aware of. We can draft your wills, and have you sign at our office, with strict compliance with Covid protocols. Normally we can take your instructions, draft your Wills, review with you, and have them ready within one week in most cases. After you have signed, we have to prepare a package for you which we can have ready shortly after you sign. We keep a scanned and saved copy, but you require the originals, so keep them in a safety deposit box or other safe place.
What are Powers of Attorney & Why do we need them?
A Power of Attorney is a document which names individuals who can make decisions on your behalf at your request and instruction.
A Power of Attorney for Personal Care allows you to name an individual(s) and substitute(s) to make personal care decisions for you, in the event that you lose the capacity to make your own personal care decisions.
A Power of Attorney for Property allows you to name an individual(s) and substitute(s) to make your banking, real estate and other property decisions for you, in the event that you lose the capacity to make your own property decisions, or if you state that the decisions may be made even if you still have capacity.
Upon your death, a Power of Attorney is no longer of any force or effect, but can be amended, or revoked while you are alive.
Normally, Powers of Attorney are drafted by our office and signed at the same time as your Will.
